Terms and Conditions for SmartCloud Online System

The following are terms and conditions to which you agree when using SmartCloud Online System supplied by Elektronines Technologijos JSC, used for remote monitoring and control of GsmAlarm devices. The document defines the limits of liability. It is not to be taken as a commercial or a sales agreement. You (hereinafter – the „User“, meaning a natural person or an entity who/which uses SmartCloud Online System) hereby agree that this agreement shall have the same power as any other written agreement you have signed.

Licence owner Elektronines Technologijos JSC hereby grants you the lifelong right to use SmartCloud Online System for the monitoring and control of GsmAlarm devices in accordance with the rules set out herein. The lifelong permission means that the User will have the right to use the online system and its updated versions as long as SmartCloud Online System exists. The User agrees that some features of the online system may be replaced or removed without any limitations. The User also agrees that Elektronines Technologijos JSC shall have the right to discontinue SmartCloud Online System at any time.

Further use of SmartCloud Online System shall be taken as an agreement with any corrections of these terms and conditions in the future.

If you disagree with these conditions, you may not use SmartCloud Online System.

Registration and account creation

In order to use the SmartCloud Online System, you will have to provide some information about yourself. You hereby confirm that all information provided during registration or updated thereafter is accurate. If any of your details change, you should update the information in your user account on SmartCloud Online System at https://smartcloud.eltech.lt/. In order to use SmartCloud Online System, you will need a password. You are responsible for the protection and use of your account password and any other activities on your SmartCloud account.

Authorisation to use SmartCloud Online System

You are allowed to use SmartCloud system from any computer or any other smart device with internet access. Elektronines Technologijos JSC does not grant you any other rights. You are not allowed to copy, edit, sell, and lease or use SmartCloud Online System program codes or hand them over to the third parties.

SmartCloud Online System changes

If necessary, Elektronines Technologijos JSC shall have the right to update SmartCloud Online System at any time. In such case, you might lose access to some of the functions or features of the previous online system versions. Elektronines Technologijos JSC may perform system changes without prior notification of the users. If necessary, Elektronines Technologijos JSC shall have the right to use foreign languages on SmartCloud Online System. Elektronines Technologijos JSC may amend or supplement the online system terms and conditions, depending on new online system changes or other additions.

Guarantee and technical support

Elektronines Technologijos JSC does not provide any guarantee that the system will meet your expectations or requirements or that by using the online system you will not experience a system error. No verbal or written information, advice or consultation provided by the personnel or partners of Elektronines Technologijos JSC shall be taken as a guarantee. You understand that the online system should not be used in situations where due to a system error it might endanger human life, property or pose the risk of any other damage.

Disclaimer

Elektronines Technologijos JSC shall not be responsible for the loss, modification or any other form of damage to the information stored on SmartCloud Online System incurred due to a system error.

Termination of use

Elektronines Technologijos JSC may, at any time and without prior warning, edit or completely remove the user account together with all its contents as well as limit certain or all SmartCloud Online System features. Elektronines Technologijos JSC retains the right to block User's IP address if it is found that the User has violated SmartCloud Online System terms and conditions or that the User may threaten the safety of online system and/or other users.

Governing legislation and jurisdiction

This agreement has been concuded in accordance with valid legislation of the Republic of Lithuania. Any disagreements or disputes in relation to this document that have not been resolved in a way of an amicable agreement shall be forwarded to the Court of Lithuania. The parties hereby irrevocably undertake to comply with the above jurisdiction.
